5. Payment Processing and Merchant of Record
5.1 Orders placed through the Site are processed by one of three payment processors: ClickBank, Stripe, or PayPal, depending on the product purchased.
5.2 For products sold through ClickBank, ClickBank is the merchant of record and the seller of the product. The ClickBank Customer Service link is provided in your order receipt and on the ClickBank website.
5.3 For products sold through Stripe or PayPal, Blue Heron Limited is the merchant of record.
5.4 Each payment processor handles your payment information under its own terms and privacy policy.
6. Refund Policy
6.1 We offer a 60-day no-questions-asked money-back guarantee on every product, regardless of which payment processor was used.
6.2 To request a refund within 60 days of purchase:
(a) For ClickBank orders: contact ClickBank Customer Service via the link in your order receipt, or visit clickbank.com.
(b) For Stripe or PayPal orders: email info@blueheronhealthguides.com with the subject line “Refund Request” and include your order details.
6.3 Once a refund is approved, your access to any digital product associated with that order may be revoked.
7. Intellectual Property
7.1 All content on the Site and in our products — including text, graphics, audio, video, software, and design — is owned by Blue Heron Limited or its licensors and is protected by copyright and other intellectual-property laws.
7.2 When you purchase a product, you receive a personal, non-transferable, non-exclusive license to use that product for your own personal, non-commercial use. You may not copy, redistribute, resell, sublicense, publicly display, or create derivative works from any product without our prior written consent.
8. Affiliate Disclosure
8.1 Some products on the Site are promoted by independent affiliates through ClickBank’s affiliate program and other affiliate programs. Affiliates may earn commissions on sales they refer.
8.2 The Site itself may also link to third-party products for which we may receive a referral fee. We only link to products we believe may be useful to our audience, but we make no representations about third-party products.

10. Limitation of Liability
10.1 To the fullest extent permitted by applicable law, in no event will Blue Heron Limited, its officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses arising from or related to your use of the Site or any product, even if we have been advised of the possibility of such damages.
10.2 To the fullest extent permitted by applicable law, our total aggregate liability arising from or related to the Site or any product, regardless of the form of the action, will not exceed the total amount you paid to us (or, in the case of ClickBank orders, the total commission we received) in the 12 months immediately preceding the event giving rise to the claim.
11. Indemnification
11.1 You agree to defend, indemnify, and hold harmless Blue Heron Limited, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, your misuse of the Site or any product, or your violation of any third-party right, including any intellectual-property right.
12. Binding Individual Arbitration; Class-Action Waiver
12.1 Mandatory arbitration. Except for claims that may be brought in small-claims court (as described below) and except for actions to enforce intellectual-property rights, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product purchased through the Site (a “Dispute”) will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted by a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.
12.2 Class-action and jury-trial waiver. You and we each waive any right to a jury trial and to participate in any class action, class arbitration, or other representative proceeding. Disputes must be brought on an individual basis only. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding. If the class-action waiver is found unenforceable as to a particular Dispute, that Dispute will be severed from arbitration and brought in court; the rest of these Terms will remain in effect.
12.3 Small-claims carve-out. Either party may bring an individual claim in small-claims court instead of arbitration if the claim qualifies under that court’s rules.
12.4 Opt-out. You may opt out of this arbitration agreement by sending written notice to info@blueheronhealthguides.com with the subject line “Arbitration Opt-Out” within 30 days of your first purchase. Your notice must include your name, address, and order number.
13. Governing Law
13.1 These Terms and any Dispute are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-laws rules.
13.2 Subject to Section 12, the courts of Hong Kong have exclusive jurisdiction over any Dispute that is not subject to arbitration.
14. Limits Upon Exclusions of Liability
14.1 Nothing in these Terms will:
(a) limit or exclude any liability for death or personal injury resulting from negligence;
(b) limit or exclude any liability for fraud or fraudulent misrepresentation;
(c) limit any liabilities in any way that is not permitted under applicable law; or
(d) exclude any liabilities that may not be excluded under applicable law.
15. Severability and Entire Agreement
15.1 If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
15.2 These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Site and any product, and supersede any prior agreements on the same subject.
15.3 We may assign these Terms without restriction. You may not assign these Terms without our prior written consent.
